STATE AID MONITORING SYSTEM IN UKRAINE: CHALLENGES OF COMPLIANCE WITH THE EU ACQUIS AND PRIORITIES FOR THE SUSTAINABLE INVESTMENT

Abstract

This article explores the functioning of Ukraine’s national system for controlling and monitoring state aid to economic entities, identifying key challenges related to its alignment with European Union law, and outlining opportunities for integrating sustainable development principles into the mechanisms for assessing and approving such aid. 

The research draws upon an analysis of the provisions of the Association Agreement between Ukraine, on the one hand, and the European Union and its Member States, on the other; the Treaty on the Functioning of the European Union; the practice of the European Commission; and current Ukrainian legislation. 

It is noted that, despite the establishment of institutional foundations for the state aid system since 2017, the full-scale war has caused a regression in the implementation of core control principles. The most significant challenges concern the suspension of the obligation to notify aid during martial law and the absence of a criterion in national legislation regarding its effect on trade between EU Member States. These factors substantially hinder the harmonization process with the EU acquis and create risks of distortion of competition in the internal market. 

Particular attention is devoted to European trends illustrating the evolution of state aid from an exception to competition rules into a strategic instrument for implementing sustainable development policy. Drawing on examples such as the European Green Deal, the Guidelines on State Aid for Climate, Environmental Protection and Energy (CEEAG), and the EU Taxonomy Regulation (Regulation (EU) 2020/852), the analysis demonstrates how state aid can stimulate envi ron mentally and socially oriented investment, enhance energy efficiency, and foster the development of green infra struc ture and an innovative economy.
