Анотація

Досліджено сучасні тенденції розвитку господарського процесуального законодавства України в умовах адаптації до права Європейського Союзу. Обґрунтовано, що євроінтеграційні процеси зумовлюють його трансформацію не лише через оновлення окремих процесуальних інститутів, а насамперед через формування нової моделі правового регулювання, орієнтованої на забезпечення ефективного судового захисту. Аргументовано, що визначальною тенденцією сучасного розвит ку господарського процесуального законодавства є посилення ролі принципу верховенства права. Встановлено, що ключовими напрямами розвитку є цифровізація господарського судочинства, забезпечення єдності судової практики, посилення активної процесуальної ролі суду та ролі Верховного Суду в формуванні сталої правозастосовної практики, а також функціональна імплементація європейських процесуальних стандартів у національне законодавство. Доведено, що
адаптація господарського процесуального законодавства України до права Європейського Союзу має здійснюватися у функціональному вимірі та передбачати не лише вдосконалення окремих процесуальних норм, а й забезпечення їх узгодженості з матеріальним господарським законодавством.
