ПУБЛІЧНІ ЗАКУПІВЛІ ЯК ЗАСІБ ПРАВОВОГО ЗАБЕЗПЕЧЕННЯ ЕКОНОМІЧНИХ ВІДНОСИН НА ЗАСАДАХ СТАЛОГО РОЗВИТКУ: СУЧАСНІ ТРЕНДИ У ПОЛІТИЦІ ЄС ТА МОЖЛИВОСТІ ЇХ УРАХУВАННЯ У НАЦІОНАЛЬНІЙ ПРАВОТВОРЧІЙ ДІЯЛЬНОСТІ

Обґрунтовано, що у праві ЄС спостерігаються тенденції щодо модифікації відомих інститутів права з метою спрямування їх потенціалу на досягнення Цілей сталого розвитку та одночасно створення розумних компенсаторів недоброчесним торговельним практикам з боку третіх країн. Наголошено на тому, що вторинне законодавство ЄС еволюціонує у напрямі розширення функціоналу публічних закупівель та впровадження обов’язкових мінімальних вимог до екологічної сталості деяких видів товарів, робіт і послуг, які є предметом публічних закупівель.
Аргументовано, що урахування нових підходів ЄС у сфері правового регулювання публічних закупівель, зокрема правових ініціатив щодо майбутніх змін у вторинному законодавстві ЄС, спрятиме визначенню перспектив удосконалення законодавства України у контексті виконання міжнародних зобов’язань з євроінтеграції.
