CONDITIONS FOR TRANSFORMING PREVENTIVE MEASURES INTO MEASURES PROVIDING THE CLAIM IN THE ECONOMIC PROCESS

Abstract

The process of transforming preventive measures applied by the court in the before&claim phase into the measures providing the claim is examined for the case of running a claim by an applicant. The main components included into the transformation of providing measures are analysed. The conditions for transformation are also analysed which are a proper making a claim under observing the relationship between the subject of preventive measures and the subject of a claim filed. The consequences of leaving claims without any action followed and dismissing of the claim are investigated.
