ORDER OF BRINGING TO ADMINISTRATIVE RESPONSIBILITY AND PROBLEM OF ITS APPLICATION IN THE CASE OF COMMISSION OF AN ADMINISTRATIVE OFFENCE

Abstract

The article considers the problem of order of bringing of persons to administrative responsibility. Lack of clear legislative fixing the order of bringing to administrative responsibility results in that its separate stages are not fulfilled by subjects of power authorities that destroys basic principles of the institute of administrative responsibility. The authors suggest to amend the current Code on Administrative Offences, to introduce obligatory pre-trial procedure of appeal of decisions on bringing to administrative responsibility, to work out the conception of responsibility of subjects of power authority for breaking the order of bringing to administrative responsibility.
