ON LEGAL REGIME FOR ENTERPRISES’ PROPERTY

Problems of Legal Regulation of Economic Activities

Abstract

Based on the analysis of current legislation, the conclusion is made that legal regime for enterprises’ property can not be determined by founders on the alternative basis and depends on the way of enterprise creation (unitary or corporate). To unify economic and civil legislation norms, it has been suggested to acknowledge unitary enterprises to be subjects of property ownership by including of the founder into their structure as the highest one(person control body given the competence (like higher control bodies of corporate enterprises) to limit the right of an executive body to manage the part of property (the right of  economic management) and the rest part of the property (or all property) – in the regime of property ownership.
