Based on the study of the national and foreign legislation, the paper considers perspective directions for the commercialization of innovations by hihger educational establishments through the creation of spin-off companies. The attention is focused on the necessity of improving the economic, tax and budget legislation in order to enhance the efficiency of the state support to innovative companies.
