Regarding ensuring implementation of safety values and preservation of cultural heritage in the light of current and draft norms of town planning legislation

Ensuring the implementation of security values and the preservation of cultural heritage should be among the main tasks
of urban planning legislation and urban planning organs. Therefore, the author has set a goal to analyze the impact
of digitalization and certain provisions of urban reform on the regulation of permissive relations in the field of urban
planning, on ensuring public interests, human rights. In the process of analysis, the question of the possibility of defining
an electronic system in construction as artificial intelligence is also considered.
The analysis of the norms of the current and planned urban planning legislation showed the presence of serious threats
to human rights in the field of urban planning, cultural heritage due to numerous gaps in the legal regulation of permissive
relations in the field of an economic activity. Once again, the inconsistency of the norms of urban planning and memorial
protection legislation, which needs to be corrected, was revealed.
Digitalization of permissive relations can have a positive effect if the algorithms of automatic issuance and the grounds
for refusal to issue permits (blocking of registration) are thought out extremely perfectly and based on a comprehensive
electronic database of reliable data necessary for decision-making. At the same time, there should be fuses in the form
of the possibility of conducting unscheduled control measures of construction objects to check the information provided
by customers.
A great caution is caused by a change in the composition of permissive bodies in the analyzed legal relations, in particular,
the involvement of notaries and state registrars of property rights to real estate on the side of the permissive authority.
The task of fighting corruption must be solved in a different way.
The author comes to conclusions about the need to make adjustments to the current permissive legislation in the field
of urban planning/ current urban planning bill No. 5655, which are substantiated in the article, in order to ensure the safety
values and preservation of cultural heritage and the implementation of relevant international obligations of Ukraine.
