LEGAL DIMENSION OF SUSTAINABLE INVESTMENT IN THE DEFENSE-INDUSTRIAL COMPLEX TAKING INTO ACCOUNT EU APPROACHES

Abstract

The possibility of attracting sustainable investments in the defense-industrial complex of Ukraine was studied through the prism of changes caused by the adoption of new EU regulatory acts in the defense-industrial sphere. The traditional approach, when investment in weapons production was not recognized as sustainable, has been changed, given that a powerful defense-industrial complex creates the basis for preventing war. In turn, this lays the foundation for sustainable development. Even after the end of the war in Ukraine, the potential for new aggression will remain. Therefore, attracting foreign capital through sustainable investment in the defense-industrial complex will be relevant. The definition of the defense-industrial complex as an object of sustainable investment in EU legal acts opens up such opportunities for Ukraine. The following defense sectors that meet the criteria for sustainable investment can be recognized: 1) production of camouflage; ammunition; non-lethal and training weapons; vehicles; medical equipment; surveillance systems, optical devices and night vision devices; reconnaissance systems, including control systems and information reading systems; communications, jamming equipment; radars and air defense systems; engines; autonomous power supply systems and human accommodation; 2) repair and maintenance of military equipment; disposal of military products; logistics and medicine; 3) contracting for capital construction of defensive structures and fortifications, etc.; 4) ensuring digitalization, in particular the creation of digital communication systems, robotics, cybersecurity. The need for enterprises of the defense-industrial complex that intend to receive sustainable investment to introduce ESG factors into their own business model is substantiated. It is emphasized that for enterprises of the defense-industrial complex, the content of environmental, social and management components differs from enterprises that do not belong to the defense-industrial sphere. The main factor is management. Mechanisms for preventing corruption, creating transparency in management and supply chains, and controlling product exports should be implemented. The social component is aimed at compliance with labor legislation, creating safe working conditions, and protecting personnel from air and missile strikes. The environmental component is shifting towards the introduction of enterprise digitalization, the introduction of energy-efficient technologies, and autonomous energy supply of the enterprise. The environmental component can also be implemented through the production of energy-efficient products for the Armed Forces of Ukraine. The potential of industrial and scientific parks, the legal regime of Defense City for attracting sustainable investments is shown, and directions for improving the current legislation regulating their legal status are outlined. Humanitarian demining and medicine are proposed as appropriate for sustainable investment.
