Abstract

The article is devoted to a comprehensive theoretical and legal analysis of the functions of Ukraine’s foreign criminallegal policy as a relatively independent direction of state policy, which is formed and implemented in the conditions of
globalization, transnationalization of crime, and intensification of international cooperation. It is substantiated that the external dimension of criminal-legal policy goes beyond the boundaries of domestic legal regulation and encompasses
a system of international legal, institutional and organizational mechanisms for combating crime, fulfilling international obligations and protecting the national interests of the state.
Based on the generalization of philosophical, general theoretical, and sectoral approaches to understanding the category of “function”, the socio-legal nature of the functions of foreign criminal-legal policy is revealed; they are defined as
objectively determined, relatively stable, and systemically interconnected directions of the state’s influence on international and domestic social relations in the field of combating crime. It is shown that the functions of foreign criminal law policy reflect the role and purpose of the corresponding direction of state activity within the framework of a broader social and legal system, which is formed by the interaction of law, politics, state institutions, and international law.
Taking into account the systemic approach to the analysis of criminal law policy, the author’s classification of the functions of foreign criminal law policy of Ukraine is proposed, which includes formative, implementation and service (support) functions adapted to the international dimension of criminal law regulation. It is concluded that the study of the functions of foreign criminal law policy is of important theoretical and practical importance for increasing the effectiveness of international criminal law cooperation and ensuring the consistency of the national criminal law system with international standards.
