LEGAL REGULATION OF BUSINESS ENTITIES IN THE TRANSITION PERIOD

The article examines the content of the Law of Ukraine "On peculiarities of regulation of the activity of legal entities of certain organizational and legal forms in the transition period and associations of legal entities". The analysis of the rules of this law indicates the imperfection of both the individual norms of its main part and changes that are made to current laws with final provisions.
It is noted that in some cases the law of the Commercial Code of Ukraine was postponed to the law without proper critical evaluation. The law uses a number of legal terms and constructions, the content of which is not defined in either the law itself or in other normative legal acts, which does not correspond to the principle of legal certainty and complicates their application. Part of the amendments to the legislation is not agreed with the provisions of the Constitution of Ukraine and international legal acts. The presence in the law of certain rules concerning the legal status of communal enterprises, the legal regime of communal property lands, can be regarded as an interference in the powers of the owner of communal property, which is the territorial community. It is proposed to eliminate the identified deficiencies in the legal regulation of legal entities of certain organizational and legal forms, without waiting for the law.
