METHODOLOGICAL FRAMEWORK AND SPECIFIC LEGAL INSTRUMENTS FOR ENSURING ECONOMIC RESILIENCE: EU EXPERIENCE AND POSSIBILITIES FOR ITS INTEGRATION INTO NATIONAL LAWMAKING

Abstract

It has been substantiated that a well-balanced state policy aimed at shaping a strategic vision of future development, resilient to internal and external challenges, becomes of existential importance, particularly in the economic sphere. It has been established that the dynamic evolution of the resilience concept highlights the relevance of updating the methodological foundations for ensuring the resilience of all state life-support systems, which is clearly demonstrated by the examp le of transformations in the EU legal system. In particular, as evidenced by EU lawmaking practice, new approaches to rule-drafting, through the integration of strategic foresight methods into the “Better Regulation” system, have become an adequate response to numerous hybrid threats. The use of megatrends, scenario-based approaches, checklists, and other tools as a scientific and empirical foundation for strategic foresight contributes to the implementation of its signalling function, which manifests itself in the early detection of risks and threats, followed by measures to manage them and minimise their impacts. It is argued that the application of strategic foresight methods in combination with risk ma nagement mechanisms is aimed at strengthening the resilience of public policy by improving the effectiveness of both lawmaking and law implementation. This is reflected in the emergence of new legal regulatory instruments as well as in the enhancement of existing ones within legislation. It is emphasised that EU lawmaking practice may serve as a benchmark for improving national legislation governing rule-drafting, by integrating strategic foresight methods and enhancing the effectiveness of legal instruments with significant potential to strengthen resilience and competitiveness (illustrated by the example of the public procurement institute).
