INSTITUTIONAL ASPECTS OF THE ADMINISTRATION OF THE SPHERE OF NATURE MANAGEMENT IN UKRAINE

Abstract

Starting from the existing contradiction between the institutional structure of a market and the institutional structure of the administrative control over the nature management, we pose the problem to seek new forms of the attainment of their correspondence and adequacy. The necessity of the institutional development of the administrative control over the nature management on the basis of a system joining of elements of the market self-organization and a regulatory policy from the side of the state, which ensures a rational use of the natural capital, is substantiated.
As present, the reformation of the structure, functions, and methods of activity of executive bodies does not ensure the efficient changes in the control over the nature management, whose final purpose is the approach of the administrative apparatus to society’s needs. The main preconditions of the further reformation of the administrative control in the sphere of nature management and the key directions of its improvement on the base of the joint interaction along horizontal and vertical of all executive bodies competent in the control over the nature management on the basis of the making of complex mutually supplementing decisions on each level (Ministry of Ecology, Ministry of Agripolicy, Ministry of Economy, Ministry of Finances, Ministry of Justice, agencies on corresponding natural resources, and territorial bodies and agencies) are determined.
The analysis of the legislative base of the control over the nature management is performed, and the main directions to improve the Law of Ukraine “On administrative services” concerning the definition of administrative services and procedures and the essence of operation of the centers presenting the administrative services and the permissing centers are indicated. The main principles of improvements in the sphere of nature management such as the innovation of methods of administration on the base of the introduction of technical means, decrease in bureaucratic barriers and the opportunist behavior of state’s officials, balance of centralization and decentralization of the administrative control functions on the basis of the account for the specificity of natural resources, etc. are determined
A new system of administration in the sphere of nature management is proposed, and the comparative analysis of the current and new models is executed by the criteria of centralization and decentralization of the management, introduction of market mechanisms and democracy in the public administration of the nature management, as well as by the criterion of accountability of the administrative executive bodies to the nature users, society, and nongovernmental organizations.
