UNION OF CO-OWNERS OF BLOCKS OF FLATS: SPECIFICITY, PROBLEMS, AND PERSPECTIVES OF THEIR ACTIVITY

Abstract

The unions of co-owners of blocks of flats (UCBF) are formed to realize the right of property by the co-owners, to improve the management of houses, and to free the state from this duty. The analysis of the dynamics of creation of the unions of co-owners in Ukraine testifies to the annual increase of their number by at least 1000. However, such rate of growth is insufficient. The unions of co-owners of blocks of flats are specific unprofitable organizations. The basis for their creation is the joint property. Therefore, the membership in UCBF should not be only voluntary. To liquidate such union is a complicated problem. In 2015, UCBF were legislatively forced to pay the tax on profits. The struggle of the community helped to remove this norm. The unions present no services (besides the lease) and are not payers of the added-value tax; this question was solved only in 2012. UCBF is managed by itself, rather than by its director. At present, the following problems are not solved: union’s property, the transfer of a land area to union’s property, nonpayments of dwellers, absence of funds on the capital repair of a house, difference in heating tariffs, etc. A part of questions have been solved on the legislative level or will be solved after the approval of bills. The creation and activity of UCBF is affected by the human factor, namely the activity or inertness of dwellers, activity and professionalism of a director, struggle of the community for the development of UCBF. The advantages of this form of economy consist in the influence of dwellers on the management of a house, higher controllability, lower expenses on the maintenance of a house in the future, etc.
